Of course, this is a case for the prosecutor. Freedom of speech does not mean, to violate the basic rights of others.

I need a good argument against fascist, when they say “it’s democracy, freedom of speech, i have the right to say what i think!”
So I’m sure there is a good logic against it since fascism isn’t an opinion, it’s a crime, but what can I say when I’m arguing with them?
There are no right arguments, because they are right. The free speech is a fundamental right of every human being. Refusing a basic right for some is fascistic. Ignore them, fight them with words and arguments, but don’t act like them. Everybody has the right to be a full asshole.
